Beyonce And Jay-Z's Blue Ivy Trademark: An Expert Explains

Couple likely 'trying to protect what they rightfully own or created,' family law expert tells MTV News.

<a href="/music/artist/knowles_beyonce/artist.jhtml">Beyoncé</a> and <a href="/music/artist/jay_z/artist.jhtml">Jay-Z</a> have filed an application with the U.S. Patent and Trademark Office to protect their month-old baby's name and reserve it for future use, MTV News has confirmed. The superstar couple reportedly sought the trademark to stop the use of Blue Ivy's name by others. <div class="player-placeholder right" title="A Gift Buying Guide For Blue Ivy Carter" id="vid:725377.id:1676907" width="240" height="211"></div> It's a smart move, according to family law attorney and author <a href="http://www.vikkiziegler.com/" target="_blank">Vikki Ziegler</a>. "[Seeking the trademark] forestalls competitors from using the child's name and or third parties from attempting to sell the baby's name back to the couple," Ziegler told MTV News. "They are likely trying to protect what they rightfully own or created, shall we say, by trademarking Blue Ivy's name." The application to trademark Blue Ivy Carter's name, filed by BGK Trademark Holdings (Beyoncé's company) is currently pending but will likely be approved because, as the <a href="http://www.washingtonpost.com/blogs/reliable-source/post/blue-ivy-the-trademark-feds-move-fast-on-rights-to-beyonce-and-jay-zs-babys-name/2012/02/03/gIQAOTDGnQ_blog.html" target="_blank">Washington Post</a> reports, parents are legally authorized to trademark the names of their minor children. "In essence, it's a trademark for a brand, and this brand is expected to be one hot commodity — just look at Blue Ivy's parents," Ziegler said. "Anyone else that tried to use the name after the trademark was approved could be sued and held liable for damages." <div class="player-placeholder right" title="Beyonce Will Emerge As A Hollywood Celebrity Mother Brand" id="vid:724613.id:1676907" width="240" height="211"></div> While the Patent Office looks fondly on attempts to trademark the name of one's own child, attempts to do the same with the names of other people's kids are another story, as two designers learned when they sought — just days after Blue Ivy's birth — to trademark the baby's name for their own use. Applications from fashion designer Joseph Mbeh to patent "Blue Ivy Carter NYC" and by an unnamed designer to trademark "Blue Ivy Carter Glory IV" for a fragrance line were denied by the Patent Office, which noted in its decision that the name belonged to a "very famous infant" and consumers would wrongly assume that any products bearing the name had been approved by Beyoncé and Jay-Z. Ziegler noted that the trademark would "protect against others using the child's name as a brand of merchandise in the same marketplace," so it will not impact the "Blue Ivy" trademark held by a clothing boutique in Sturgeon Bay, Wisconsin. The store filed to trademark its name on January 19, 2011, a year before Queen B and Jay made the name famous. They received approval on August 23 — five days before <a href="/news/articles/1669849/beyonce-pregnant-vmas.jhtml">Beyoncé announced her pregnancy</a> at the MTV Video Music Awards. "Those photographers are very crafty, even if Beyoncé and Jay-Z think they're doing all they can to keep Blue away from photographers. But ultimately, I think you can expect to see her baby photos in a magazine pictorial, and that will be Blue's introduction to the world. That's the real reveal people want to see." Mixing his signature bachata flair with some R&B, he is showing fans a whole new side on his debut album, Formula, Vol. 1. <div class="player-placeholder right" title="Romeo Breaks Into Mainstream With Lil Wayne" id="vid:734074" width="240" height="211"></div> Hoping to spread his unique sound and style to a mainstream audience, Santos enlisted <a href="http://www.mtv.com/music/artist/lil_wayne/artist.jhtml">Lil Wayne</a> for his latest single, "All Aboard." "This song 'All Aboard,' that tune allowed me to expand and kind of offer my audience something totally different because it's not bachata — I'm singing English and that was really fun," Santos recently told MTV News. "I was a little nervous about that, but people actually really accepted it." Santos and Weezy recently shot the video for "All Aboard" in Miami; he called the clip "sexy," "seductive" and "elegant," but also revealed that this collaboration came very close to not making his album. "I was just like, I like the song but it's missing something, and at first I couldn't figure out what it was," Santos said. "What we did was we left 16 bars open, and I was like, you know, who would rip this track? Lil Wayne. So we reached out. It barely made the album because he's a busy dude, so he actually got on the record two months after we submitted it. It was like, if we don't get his vocals in the next two days we hit, and we got it, so we made it and the song is just really great." Wayne isn't the only artist Santos pulled in for his album. On his last single, "Promise," he teamed up with <a href="http://www.mtv.com/music/artist/usher/artist.jhtml">Usher</a>, who last week joined him onstage at <a href="/news/articles/1678993/romeo-santos-solo-tour.jhtml">Santos' first of three sold-out shows</a> at New York's Madison Square Garden. "I felt at that moment once again I was going to revolutionize bachata 'cause it was the first time that you hear an artist from the mainstream singing bachata," Santos said. "It was a big deal." <a href="http://www.mtv.com/music/artist/lady_gaga/artist.jhtml" target="_blank">Lady Gaga</a>, Katy Perry and <a href="http://www.mtv.com/music/artist/adele/artist.jhtml" target="_blank">Adele</a> had huge years in 2011, with major tours, strings of hit singles, Grammy wins and #1-hogging chart-topping albums. But when <a href="http://www.billboard.com/news/music-s-top-40-money-makers-2012-1006415552.story#/news/music-s-top-40-money-makers-2012-1006415552.story" target="_blank">Billboard</a> magazine compiled its 2012 list of "Music's Top 40 Money Makers" it was <a href="http://www.mtv.com/music/artist/swift__taylor/artist.jhtml" target="_blank">Taylor Swift</a> who ruled them all. In fact, the 22-year-old country-pop darling out-earned all of her fellow ladies combined. <embed src="http://media.mtvnservices.com/mgid:uma:video:mtv.com:732753/cp~vid%3D732753%26uri%3Dmgid%3Auma%3Avideo%3Amtv.com%3A732753" width="460" height="260" type="application/x-shockwave-flash" allowFullScreen="true" allowScriptAccess="always" base="."></embed> According to the magazine's calculations, Swift earned her #1 spot on the list thanks to reported earnings of $35.7 million in the 2011 calendar year. Those earnings came from a combination of revenue from the quadruple-platinum-plus sales of Speak Now and its accompanying tour, which grossed $88.5 million in the U.S. alone. But because Swift writes her own songs, she rolled up a big chunk of change in songwriting royalties as well. Right behind Swift was iconic rock band U2, who earned a reported $32.1 million thanks to their record-setting 360 Tour -- which grossed a whopping $736 million total over two years -- including $50 million in merchandise sales and 1.4 million in digital track sales. Country singer Kenny Chesney was #3 with $29.8 million, followed by previous tally topper Gaga at #4 with $25.3 million. She stayed in the top 5 thanks to sales of Born This Way and its accompanying Monster Ball Tour, which grossed more than $51 million. She also moved 12.7 million digital tracks. Lil Wayne rounded out the top 5 with $23.1 million, made up of 12.3 million digital track sales, $44.7 million in tour grosses and cash from his gig as founder of Young Money Entertainment. The rest of the top 10: Sade (#6, $16.3 million), Bon Jovi (#7, $15.8 million), Celine Dion (#8, $14.2 million) and Jason Aldean (#9, $13.4 million). Adele rounded out the top 10 list at #10 with $13 million, mostly from the unstoppable streak of her 21 album's <a href="/news/articles/1680635/adele-21-album-billboard-charts.jhtml">chart run,</a>  which included sales of 6.7 million copies last year alone. The "Glee" cast were just outside the top 10 at #11 ($12.5 million), Katy Perry hit #14 ($11.9 million), Britney Spears was at #16 ($10 million) and like her sisters in pop, Rihanna made it to #22 ($7.6 million) through a combination of album and single sales and touring revenue. Other notable entries: Enrique Iglesias (#23, $7.4 million), Usher (#30, $6.2 million), Foo Fighters (#31, $6 million), Justin Bieber (#35, $5.5 million), Kanye West (#39, $5.3 million) and Linkin Park (#40, $5.1 million). Billboard calculated the figures based on proprietary data from its Boxscore archives for concert grosses, Nielsen SoundScan for sales of physical and digital albums, singles and ringtone sales, and Nielsen BDS for terrestrial radio play and streaming service information.

<a href="http://www.mtv.com/music/artist/rihanna/artist.jhtml">Rihanna</a> and <a href="http://www.mtv.com/music/artist/usher/artist.jhtml">Usher</a> have been added to the performance lineup for "The <a href="/news/articles/1673138/lady-gaga-grammy-nominations-concert.jhtml">Grammy Nominations Concert Live!</a> Countdown to Music's Biggest Night," set to go down November 30. They join already announced acts Lady Gaga, Ludacris, Lupe Fiasco, Sugarland and Jason Aldean. Country crossover act the Band Perry will perform a full concert of their own after the <a href="http://www.mtv.com/news/grammys">Grammy</a> nominations concert wraps up at L.A. Live's Nokia Theatre. LL Cool J will again host the show, which will air at 10 p.m. on CBS, <a href="http://www.billboard.com/news/rihanna-band-perry-usher-added-to-grammy-1005529002.story#/news/rihanna-band-perry-usher-added-to-grammy-1005529002.story" target="_blank">Billboard.com reports</a>. This marks the fourth year the Recording Academy had held one of these concerts. As some of music's biggest names take the stage during the special, the nominations for major Grammy categories will be announced. The awards ceremony will go down February 12 at the Staples Center, and will air live at 8 p.m. Over the course of her career, Rihanna has taken home four Grammy Awards including Best Rap/Sung Collaboration for "Umbrella," two trophies for "Run This Town" (including Best Rap Song and Best Rap/Sung Collaboration) and Best Dance Recording for "Only Girl (In the World)." Rihanna is currently riding high on the forthcoming release of her new album, <a href="/news/articles/1674237/rihanna-talk-that-talk-watch-learn-hit-boy.jhtml">Talk That Talk</a>, and two buzzworthy singles, "We Found Love" and "You Da One." In the thirteen years he's been nominated for Grammys, Usher has amassed seven, including wins for Best R&B Vocal Performance Male for "U Remind Me," Best R&B Vocal Performance Male for "U Don't Have To Call," Best Rap/Sung Collaboration for "Yeah," Best Contemporary R&B Album for Confessions, Best R&B Vocal Performance By a Duo/Group for "My Boo," Best Male R&B Vocal Performance for "There Goes My Baby" as well as Best Contemporary R&B Album for Raymond v. Raymond. Recently, he has been taking over airwaves with his <a href="/news/articles/1670301/usher-david-guetta-without-you.jhtml">David Guetta track, "Without You."</a>

All the single ladies: Put your hands up and show Beyoncé some love for looking so smoking hot just 10 weeks after <a href="/news/articles/1676906/beyonce-jay-z-baby-born-ivy-blue.jhtml">giving birth to her baby girl, Blue Ivy</a>. After multiple sightings of the star out and about in NYC since she first emerged at a <a href="/news/articles/1678726/beyonce-post-baby-appearance-blue-ivy.jhtml">Jay-Z's post-Carnegie Hall party</a>, the singer got all dolled up to hang out with first lady Michelle Obama in Manhattan on Monday night. The first lady of hip-hop and the actual first lady gathered at the Greenwich Hotel for a fundraising event for President Obama. Along with raising some dough, Beyoncé also raised eyebrows, thanks to her slamming post-baby body. Decked out in a body-hugging navy dress by Victoria Beckham, B rocked sky-high heels, dazzling bling (including a diamond-encrusted eagle) and her hair pulled back in a simple ponytail. So what was Beyoncé doing right in terms of styling herself as a new mom? "When you think of all the things women dislike about themselves, the majority don't like their upper arms and also have skirt-length issues, so she's addressed both of these. It's an interesting choice because it's snug, not tight," celebrity stylist Robert Verdi told MTV News about B's post-baby style. "There's a distinction. It's body-flattering, for sure. "It's also a very tasteful length: 2 inches above the knee. It's also a very conservative color, and it's very covered, but it still remains very sexy," he continued about the look. "You don't see all the bumps that women have post-pregnancy. ... Again, the distinction is it's body-conscious without revealing every lump and bump. Tight ain't right, but this ain't tight. This is body-skimming." With Beyoncé heading back into the spotlight more and more, including a set of <a href="/news/articles/1681308/beyonce-memorial-day-atlantic-city-shows.jhtml">shows planned for Memorial Day weekend</a>, does Verdi think Queen B will reassess her stage style now that she's a mom? "She's really young, and ... her equity is in her sex appeal, so you can't dismiss that," Verdi said. "She's not going to cover up. I think you've seen a similar evolution with Madonna, where fashion is sexy but is more intellectual. It's not as in-your-face. I think you're going to see the same thing with her.
